Higher Counthill Farm Livery Guidelines, Rules and Terms & Conditions These rules are designed to protect the health, safety and welfare of those who use, visit or are affected by the workings of the livery. Booking Cancellation

If a non-member has a pre-booked arena at Higher Counthill Farm and wishes to cancel they must do so by giving a twelve-hour-notice before the booking is due. Failure to cancel within twelve-hours will result in losing the pre-booked arena. Fifty percent of the booking amount will be refunded.

Users must send an email to info@highercounthillfarm.co.uk to action any cancellations. Users can collect their refunds in cash only. The monies can be collected from the HCF office.

If the pre-booked arena is cancelled within twenty-four-hours, a promotional code will be issued to you via email which you can use against the same facility that you originally booked. The promotional code will be valid for 90 days from date of cancellation. If the promotional code remains unused for the 90 days the promotional code will become invalid after this period has ended and no refunds will be made against it.

All stables at Higher Counthill Farm or HCF are billed on a weekly rolling contract. Payment for stable(s) will be debited from registered users accounts automatically every week on Monday.

If a stable owner wishes to terminate their stable ownership it is the stable owner’s responsibility to give 7 days’ notice prior to ending the agreement.

Stable Deposit

If the user has a stable or multiple stables, the user must give a weeks rent as a deposit. This will refunded in cash if:

1. 7 days notice is given verbally, text message or via email.

2. If any rent is outstanding this will deducted from the deposit.

1- General

No smoking is permitted – this includes visiting instructors, farriers and vets.

1.1 Anyone wishing to smoke must do so away from the premises.

1.2 All livery clients are asked to declare any vices their horses / ponies may have, including stable and field vices.

2. Any instructor / vet / farrier visiting the site must be suitably competent and insured and made aware of these Livery Rules and emergency procedures.

3. None of the mechanical equipment in the yard or farm may be used by any livery client.

4. No persons are permitted to access any bales storage areas in the farm. Hay /shavings will be brought to the designated areas of the stables for use

5. All children under the age of 16 years must be supervised by an adult and under control at all times.

6. All persons riding on the site must wear a riding hat which is up to the correct current standards: BS EN1384, PAS 015 or ASTM 1163, fits correctly and has the harness fastened at all times when riding on the premises.

7. All cars and trailers must be parked in a safe and tidy manner in the appropriate yard areas.

8. All livery clients are requested to report any damage or defects to the HCF propreitor immediately; whether to stables, arenas, fencing or paddocks.

9. All livery clients should be aware of the emergency procedures which are displayed in the yard and familiarise themselves with these.

10. All accidents occurring on the premises must be immediately reported to he HCF propreitor.

11. For your own safety, you are advised to inform the HCF proprietor of any medical conditions which may require emergency treatment when you are on the site, such as epilepsy or diabetes. This information will be treated in the strictest confidence.

12. Be aware that there are movement of agricultural vehicles and use of equipment.

13. Please stay out of these areas where possible.

14. Please be considerate to other livery clients, horses and contractors.

14.1 No hay nets or tethering of horses outside stables

14.2 You are responsible for the cleanliness in front of your stable at all times, failure to do so will result in a fine of £25

14.3 All facilities must be booked prior to use, there will be a £25 fine for people who have not booked in.

14.4 If you miss your booking 3 times there will be a month’s ban on all facilities except wash room.

14.5 You must have a dedicated person on the floor to poo pick while you are riding in the arenas. The dedicated person on the floor must be in the arenas to assist the horse rider(s) for their; health and safety and general cleaning up after the horse(s).

14.6 Stables are to be painted in white with a black bottom only.

14.7 There is to be no loose hay/haylage carried at anytime

14.8 Bedding can be purchased from Higher Counthill Farm

14.9 Higher Counthill farm reserve the right to terminate any contract for failure to adhere to the rules.

14.10 There are to be no loose horses on or around the yard at any time unless turned out.

14.11 We reserve the rights to change terms & conditions without notice.

15. Horses & Riding

15.1 All livery clients are asked to declare any vices their horses may have, including stable and field vices.

15.2 Livery clients should be aware of the temperaments of all horses, they share paddocks with or have contact with.

15.3 Please do not touch, or allow children and other visitors to touch, other customer’s horses.

15.4 Entry to stables is restricted to persons who have permission of the horse owner.

15.5 Only two horses per handler to be taken in and out of field / sand paddock.

15.6 Under no circumstances should more than two horses be led by one person.

15.7 A suitable head collar and lead rope must be used.

15.8 All persons riding on the site must wear a riding hat which is up to the correct current standards: BS EN

15.9 PAS 015 or ASTM 1163, fits correctly and has the harness fastened at all times when riding on the farm premises.

15.10 For your own personal safety you should wear suitable foot wear.

15.11 Body protectors are strongly advised for jumping and fluorescent equipment is recommended when riding on the road.

15.12 The wearing of protective hats, gloves and, if necessary, body protectors are recommended when turning out or bringing in difficult or young horses.

15.13 Unless agreed with proprietor, clients are responsible for checking, feeding, and caring for their horse(s).

15.14 Please make sure that horses have clean drinking water at all times. Bedding must be kept in an adequate condition.

15.15 Horses should be kept in a good physical condition; up to date with any worming and vaccinations required.

15.16 In the event of an owner going on holiday, provision must be made for a nominated person to have access to the horse’s passport in case of veterinary treatment / destruction required.

15.17 Should a horse fall ill, the proprietor reserves the right to call the veterinary surgeon if this is deemed necessary.

15.18 Any necessary action advised by the veterinary surgeon will be taken.

15.19 If it is recommended that the horse is destroyed and the owner cannot be contacted, the vet and the proprietor reserves the right to make an informed decision in the horse’s best interests.

15.20 Should a horse die on the premises it is the owners responsibility to make arrangements for its safe disposal.

16. Children & Dogs

16.1 All children under the age of 16 years must be supervised by an adult and under control at all times, unless specifically agreed with management.

16.2 Children under the age of 16 years should never be left at the site unaccompanied and an adult must always be present when the child is riding.

16.3 Dogs must be kept on lead, although it is preferred that they are not brought onto the site in case they spook or disturb the other horses.

17. Visitors

17.1 Visitors are only permitted on the farm if they remain under the close supervision of the livery client.

17.2 Any instructor / vet / farrier visiting the site must be suitably competent and insured and made aware of these Livery.

16.3 Dogs must be kept on lead, although it is preferred that they are not brought onto the site in case they spook or disturb the other horses.

18. Rules and emergency procedures - Housekeeping

18.1 You must muck out and bed down properly the stable used by your horse.

18.2 All livery clients are requested to report any damage or defects to the proprietor immediately whether to stables, arenas, fencing or paddocks.

18.3 After use of the sand paddock all jump blocks / poles etc., must be put away in a tidy manner.

18.4 Ensure that rubbish is disposed of correctly and not left lying around where it may attract rodents or create a trip hazards.

18.5 All mucking out tools such as forks / brushes / wheelbarrows etc., are to be tidied away when finished with.

19. Fire safety

19.1 No smoking is permitted – this includes visiting instructors, farriers and vets.

19.3 All livery clients should be aware of the emergency procedures which are displayed in the washroom and familiarise themselves with these.

20. Electrical safety

20.1 If any portable electrical appliances used on the premises, such as clippers, they must be maintained in good condition and plug / cable inspected on a regular basis for damage.

20.2 Please do not leave portable electrical appliances plugged in when not in use or leave cables trailing in such a way that it could cause harm to others, including horses.

21. Hazardous products

21.1 All hazardous products used on the site, such as disinfectants or veterinary products, should either be taken away after use or kept in a secure locked place to prevent access by unauthorised persons, including children.

22. Vehicles

22.1 Take care when driving on the site and keep to a maximum speed limit of 5 mph – remember there are horses, other people (including children) and farming activities around.

22.2 All cars, horseboxes or trailers must be parked in a safe and tidy manner.

22.3 Higher Counthill Farm does not accept any liability for such items and insurance is the responsibility of the owner.

23. Other Activities

23.1 Be aware that other activities take place at Higher Counthill Farm such as movement of tractors / work equipment. Please stay out of these areas where possible.

23.2 Use or interference with any of the business’ or contractor’s machinery or equipment is prohibited.

23.3 Accidents and first aid All livery clients should be aware of the emergency procedures which are displayed in the washroom and familiarise themselves with these.

23.4 All accidents occurring on the premises must be immediately reported to the proprietor.

23.5 First aid supplies can be found in the washroom.

24. Insurance & Security

24.1 Owners are fully responsible for any damage to persons or property by, or in connection with their own horse, and must have Public Liability Insurance.

24.2 A copy of the horse(s) insurance must be provided to management.

24.3 You should consider taking out Personal Accident Insurance and insurance for your horse, to include loss of animal, vet’s fees, and other associated costs.

24.4 If you are leaving the site unoccupied, please ensure all gates are closed and locked.

24.5 You are advised to take any tack and equipment home with you as a secure tack room is not provided.

24.6 Higher Counthill Farm cannot accept responsibility for any loss or damage to tack or other personal belongings left on the premises.

25. Payment and cancellation of contract

25.1 You will be charged at the current rate which is displayed on the website.

25.2 Higher Counthill Farm may increase its charges by giving not less than one week notice in writing.

25.3 No sub-letting of paddocks, stables, storage sheds or parking is permitted.

25.4 No animals other than horses that you pay livery for are to be kept on site.

25.5 The livery contract may be terminated either by yourself or the proprietor by giving 7 days written notice.

25.6 On or before expiry of this notice, all accounts must be settled in full. Failure to do so may result in legal action being taken against you.

26. Video Recordings

26.1 All recordings that are booked via the website or the HCF mobile app are owned and operated by HCF.

26.2 Any distribution of video recordings by registered users are done so at their own risk.

26.3 Users may display video recordings on their personel social networks

26.4 HCF reserves the right to use any video recordings for advertising or marketing purpose

26.5 Videos are stored on HCF secure servers. Video recordings are kept on the servers for a maximum of three days, after which they are permanently deleted.

26.6 Users will be notified via the mobile app and or via the registered email to view or download the video recording(s).

26.7 Users will be notified via the app and or email before the video recordings are permanently deleted.

26.8 If the video recording equipment becomes faulty or there is an IT issue outside of HCF’s knowledge HCF are not liable. Users will not be refunded for any bookings made including any video recording costs.

26.9 If any agreements are made as a result of this, this is at HCF’s managements discretion.

27. Facility Cancellations

27.1 Any facilities that are cancelled at HCF, users must give 12 hours notice prior to booked time.

27.2 Users that cancel within this period will receive a fifty percent of the original amount.

27.3 Users must send an email to info@highercounthillfarm.co.uk to action any cancellations.

27.4 Users can collect their refunds in cash only. The monies can be collected from the HCF office.
